These Terms of Service (“Terms”) govern your access to and use of DayTraitor (the “Service”), operated by DayTraitor (“we,” “us,” or “our”). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
2. Accounts
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. Authentication is handled by our service provider; you are responsible for keeping your email and password secure.
3. Subscriptions, billing, and refunds
- The Service is offered on a paid subscription basis. Payments are processed by Stripe; we do not store your full payment card details.
- New subscribers may receive a 7-day free trial. A valid payment method is required to start the trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and your payment method will be charged.
- Subscriptions renew automatically for the applicable billing period until canceled. By subscribing, you authorize recurring charges to your payment method after any free trial.
- You may cancel at any time; cancellation takes effect at the end of the current billing period, and you will retain access until then.
- Except where required by law, fees are non-refundable and partial periods are not prorated.
- We may change pricing on a prospective basis with reasonable notice.
4. Acceptable use
You agree not to:
- resell, redistribute, scrape, or republish data or content from the Service;
- share your account, circumvent access controls, or use the Service in excess of normal, individual use;
- interfere with or disrupt the Service, or attempt to gain unauthorized access to any systems or data;
- use the Service for any unlawful purpose or in violation of any applicable regulation.
5. Intellectual property
The Service, including its software, design, and original content, is owned by DayTraitor and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
6. Third-party data and services
The Service relies on third-party providers, including Financial Modeling Prep (market data), Stripe (payments), and our hosting and database providers. Data is provided “as is” and may be delayed, incomplete, or inaccurate. We are not responsible for the acts, omissions, or content of third parties.
7. No investment advice
The Service is for informational and educational purposes only and does not constitute investment, financial, legal, or tax advice. See our Disclaimer for important details. You are solely responsible for your trading and investment decisions.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DayTraitor AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless DayTraitor from any claims, damages, liabilities, and expenses arising out of your use of the Service or your violation of these Terms.
11. Termination
We may suspend or terminate your access at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the Service after changes become effective constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-law principles.
